NEW DELHI — The Supreme Court of India has agreed to hear a public interest litigation (PIL) seeking directives to compute Minimum Support Price (MSP) based on the comprehensive cost of production (C2-calculation) across all agricultural commodities. A bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi issued formal notices to the Union Government, the Commission for Agricultural Costs and Prices (CACP), and related authorities, asking them to submit their responses to the petition.
The petition underscores the systemic financial strain confronting agricultural communities, pointing to escalating rural indebtedness and widespread distress sales. Represented by senior counsel, the petitioners argue that existing floor price mechanisms fail to cover real operational and capital outlays incurred by cultivators.
The key relief sought in the PIL includes:
Transition to Comprehensive {C2} Costing: Replacing the current {A2}+{FL} baseline model with the comprehensive {C2} cost formula. While the standard framework covers direct cash expenses and family labor, the {C2}benchmark incorporates the rental value of owned land and interest on fixed agricultural capital.
Adherence to Swaminathan Commission Benchmarks: Implementation of recommendations from the National Commission on Farmers, chaired by Dr. M.S. Swaminathan, which advised setting floor prices at least 50% above the complete {C2} production cost.
Statutory Procurement Protection: Establishing an enforceable framework directing state and central procurement agencies to guarantee complete off-take for all notified crops at the recalculated support price.
During preliminary proceedings, the top court noted the significant economic policy considerations surrounding mandatory floor prices. The bench observed that agricultural input parameters—particularly land values and capital costs—vary considerably across different regions and states, posing practical challenges for uniform price formulas.
While acknowledging the state’s welfare obligations toward smallholders and rural livelihoods, the court highlighted the necessity of balancing farmer protection with broader macroeconomic dynamics and national procurement policies.
The Central Government and regulatory bodies are slated to file their formal replies as the matter moves forward in subsequent hearings.
